Terms of Service

Note: ALKARTIS is operated by ALKARTIS LLC, a pre-money, pre-revenue beta-stage company. This document is a general-purpose template, not legal advice, and is being reviewed and finalized by counsel.

These terms govern your use of ALKARTIS products and this website, operated by ALKARTIS LLC ("we," "us," "our").

1. Who we are and what this is

ALKARTIS builds intelligence tools on top of publicly available government records — currently CompensationAtlas and TaxAssessmentIQ, with LandlordEye, BlockWatcher, and ListingIQ in development. We are an independent, private company and are not affiliated with, endorsed by, or acting on behalf of the City of Philadelphia or any of its departments or agencies, including the Office of Property Assessment (OPA) or the Board of Revision of Taxes (BRT).

2. Not legal, tax, appraisal, or real estate advice

ALKARTIS products are informational tools only. They are not legal advice, tax advice, a certified appraisal, an official government assessment, or a representation service. We do not file appeals, permits, or other submissions on your behalf, and we do not represent you before any government agency. ALKARTIS is not a law firm, not a licensed real estate appraiser, and not a tax representative. Only the relevant government agency (such as the OPA) can issue an official assessment. You are responsible for your own filing decisions and deadlines. For advice about your specific situation, consult a qualified professional.

3. No guarantee of outcomes

Outcomes such as a property assessment appeal, a real estate sale, or a leasing decision are decided by the relevant agency, court, or counterparty — not by ALKARTIS. Any figures, scores, or estimates shown in our products (including comparable-sales estimates, neighborhood scores, or potential savings) are derived from public records and our own models, which carry a margin of error. They are estimates, not promises. Always verify critical figures against your official notice or record before acting.

4. Beta status

ALKARTIS products are currently provided as a beta service. Features, availability, and pricing may change without notice during this period. Material changes to pricing will not retroactively affect a billing period you've already paid for.

4a. Service availability

ALKARTIS products and this website are provided on an "as available" basis. We do not guarantee uninterrupted or error-free availability, and we do not offer a service-level agreement (SLA) or uptime guarantee during the beta period. Access may be interrupted or delayed by scheduled maintenance, technical issues, or outages or delays in the underlying government data sources we rely on — some of which are outside our control (see Section 7). Current operational status, when available, is published at our status page.

5. Products and pricing

ALKARTIS offers two kinds of paid access:

Subscription tools (CompensationAtlas, TaxAssessmentIQ, LandlordEye, BlockWatcher, Building Code Lookup): billed monthly per the plan you select. See Pricing for current tiers. You can cancel at any time; cancellation takes effect at the end of the current billing period.

ListingIQ HomeBrief reports: a one-time, per-report purchase. There is no subscription or recurring charge for HomeBrief reports, and purchasing one report creates no obligation to purchase another.

TaxAssessmentIQ appeal packets: a one-time, per-property purchase, separate from the subscription. Checking whether you’re over-assessed is free; if you choose to file, the packet fee is 10% of the first-year savings we estimate (subject to a minimum base preparation fee), and is backed by our Fair-Assessment Guarantee. During the current beta, appeal packets are free.

6. Refund policy

Subscription tools: you may cancel anytime. Cancelling stops future billing but does not refund the current billing period already in progress, since you've had access to the product for that period.

ListingIQ HomeBrief reports: because a report is a delivered digital product, we do not offer refunds simply because you changed your mind after downloading it. We will provide a full refund if: (a) the report fails to generate, or (b) the report contains materially incorrect data about the property (for example, the wrong parcel or values that don't match the public record as of your purchase date). Contact us within 14 days of purchase to request a refund under these conditions.

TaxAssessmentIQ appeal packets: covered by our Fair-Assessment Guarantee. In short: if the City’s decision saves you less than we estimated, we refund the difference (down to the base preparation fee); and if an appeal leads the City to raise your assessment, we refund your fee in full. Request a refund from your account within 30 days of your appeal decision; we verify the outcome against the City’s published assessment. During the current beta, these packets are free.

What we never refund: except as provided by the Fair-Assessment Guarantee above, outcomes outside our control — such as the result of a real estate transaction or a leasing decision — are not grounds for a refund, since ALKARTIS does not control or guarantee those outcomes (see Section 3).

7. No warranty

ALKARTIS products are provided "as is," without warranties of any kind, express or implied, including fitness for a particular purpose. We make reasonable efforts to keep public-record-derived data accurate and current, but we do not guarantee completeness or accuracy, and our products should not be treated as a substitute for the official government record.

8. Acceptable use

You agree not to misuse ALKARTIS products — including scraping at scale without permission, reselling or republishing our reports as if they were official government documents, reverse-engineering our underlying models, or using the data to harass or discriminate against any individual.

9. Intellectual property

What we own: the ALKARTIS name and logo, this website, our product designs and report formats, our underlying models, and our own data compilations belong to ALKARTIS. This does not extend to the underlying government records themselves — see Section 9a below.

9a. Data sources and third-party terms

ALKARTIS products are built on data published by government sources, including datasets accessed through OpenDataPhilly — a catalog that aggregates open data from the City of Philadelphia as well as other organizations across the region, rather than a single City-run system. The City of Philadelphia reserves all rights in its own database and the data it contains. Using ALKARTIS products does not transfer to you, and you do not receive, any title or interest in the City's database or its underlying data — only in the reports and analysis ALKARTIS itself produces from it.

Per the City of Philadelphia's own terms of use: the City makes no representation about the accuracy of any specific information in its data, which is provided "as is" and without warranty of any kind, and the end user assumes complete responsibility for any outcome resulting from its use. ALKARTIS passes this same posture through to you: our products add analysis and context on top of this public data, but we do not and cannot guarantee the underlying City data is error-free.

Because OpenDataPhilly is a catalog rather than a single publisher, individual datasets may carry additional restrictions set by their original creator, separate from the City's own terms — this matters in particular for commercial use, which is how ALKARTIS operates. We review the applicable terms for each dataset we build on; if you have questions about a specific dataset's provenance or restrictions, contact us and we'll point you to the original source.

What you get when you pay for access: a personal, non-exclusive, non-transferable license to use the product or report for its intended purpose (for example, filing a TaxAssessmentIQ appeal packet, or sharing a ListingIQ HomeBrief with your own clients or advisors). This license does not permit resale, mass redistribution, or republishing our reports as your own original work.

10. Dispute resolution

Please read this section carefully — it affects how disputes between us are resolved. If you have a concern, please contact us first at hello@alkartis.com so we can try to resolve it informally. If we can't resolve a dispute informally, both you and ALKARTIS agree that any claim arising out of or relating to these terms or our products will be resolved through individual binding arbitration rather than in court, except that either party may bring a qualifying claim in small-claims court. Both parties waive any right to a jury trial or to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase and stating that you opt out; doing so will not affect any other part of these terms.

11. Indemnification

You agree to indemnify and hold ALKARTIS harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of our products, your violation of these terms, or decisions or submissions you make to any government agency, court, or counterparty based on information obtained through ALKARTIS.

12. Limitation of liability

To the maximum extent permitted by law, ALKARTIS's total liability for any claim relating to our products is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages arising from use of our products or this website.

13. Changes

We may update these terms as the product and company evolve. The "last updated" date above reflects the current version, and material changes will be posted here.
